Possible compensation
up to
€ 2.500
X (formerly Twitter) has been engaging in unlawful practices
for years to generate more visitors and advertising revenue.
By using manipulative practices combined with a lack of
transparency about the use of consumer data, X unfairly
benefits from its millions of users.
For
years, X has been manipulating its users by not providing
sufficient transparency about how (sensitive) data is used to
enhance the Big Tech practices. Data breaches are
systematically concealed, insufficient action is taken
against hate speech, and investigations into such incidents
are severely hampered. Additionally, X manipulates its users
by offering advertisements that (illegally) target political
and religious preferences without the knowledge of the X
user.
SOMI
wants this to stop. SOMI is committed to addressing these
issues and advocate for consumers by demanding more freedom
of choice and transparency, and to seek compensation for the
damage and unjust enrichment caused by X.
What SOMI Demands
SOMI demands that X cease illegal activities such as using sensitive data for targeted advertisements, concealing data breaches, and taking insufficient measures against hate speech. X is currently financially profiting at the expense of users through these unlawful practices. Therefore, SOMI argues that X should be held accountable and that all affected users should be compensated for the damage they have suffered. It is necessary for X to take responsibility and stop these harmful activities to ensure the privacy and safety of its users.

What Is The Claim About?

Data Leaks
Between
January 2022
and January
2023, four
data breaches
occurred at
X, resulting
in the
personal data
of hundreds
of millions
of users
being leaked
onto the Dark
Web. During
these
incidents, X
failed to
take
appropriate
security
measures and
did not
adequately
follow up on
the data
breaches (by
informing the
authorities
and affected
users
properly).

Microtargeting
X unlawfully used sensitive user data such as political opinions and religious beliefs for targeted advertising. X used this sensitive data, among other things, to determine whether an EU Commission advertising campaign supporting the controversial chat control legislation in the Netherlands would be shown. Moreover, X's public register, which should provide insight into the targeting criteria of advertisements, does not meet the requirements. X continues to operate unlawfully and without proper oversight in this area.

Hate Speech
X fails in
its
obligation to
take
sufficient
measures
against
systemic
risks on its
platform,
including
combating
content
motivated by
hate,
prejudice, or
intolerance.
Various
studies
confirm that
hate speech
has increased
significantly
since Elon
Musk took
over X. X
displays ads
alongside
hate messages
and profiles
of X users
who post hate
speech.
Research on
X's data is
severely
hampered.
These actions violate European and national data protection and consumer laws, including the General Data Protection Regulation (GDPR), the Digital Services Act (DSA), and the Unfair Commercial Practices Directive as implemented in the Dutch Civil Code. These actions have caused harm to X users and visitors.
